エンジンかけ車離れたら違反 注意［2024.5.6］

「家に帰るまでが遠足です」多くの人が小さい頃に聞いたこの言葉。これはGWに旅行や帰省などを楽しんで、これから自宅に帰る人たちにも言える言葉だ。楽しい思い出の最後を事故や警察による取締りで締めくくらないように、Uターン前に気をつけたい交通ルールを取材した。

■高速道路上では”十分な車間距離”を

車で長距離移動する際には欠かせない高速道路。しかし、万が一事故を起こした場合には命を落とす危険性もあり、交通ルールや法定速度を順守することが大切だ。

中でも重要なのが「十分な車間距離の確保」だ。近年社会問題となっている“あおり運転”。

2020年6月から道路交通法が改正され、あおり運転も厳罰化されたが、こうした問題に発展しないためには車間距離を十分にとることが必要となる。十分な車間距離を保っていない場合には”車間距離不保持違反”となり「妨害運転（交通の危険のおそれ）」とみなされ、3年以下の懲役、又は50万円以下の罰金や免許取り消しなどの重い処分が下される。道路交通法では十分な車間距離について「追突を避けられる距離を保つこと」と記載されていて、具体的な距離については言及されていない。

新潟県警交通指導課は「ドライバーが危険を感じてからブレーキを踏んで、実際に車が停止するまでの距離は、空走距離と制動距離が合わさってある程度の停止距離を要する。高速道路上では特に余裕を持った車間距離が必要」と呼びかける。

計算上、時速80㎞で走っていた場合の車の停止距離は76m、時速100㎞で走っていた場合には112mの距離を要する。県警高速隊などが高速道路上をパトロールしている際、車間距離が短い車両を見かけた場合には、マイクで注意する一方で、あまりにも短い場合には停車させて切符処理や検挙する可能性もあるという。

■高速道路上でのガス欠、左車線からの追い抜きは違反?

高速道路上で気をつけたいのはガソリンがなくなるガス欠だ。高速道路でガス欠になってしまった場合には違反になるのか?

道路交通法によると「高速自動車道等運転者遵守事項違反」として明記されていて、違反点数2点と、大型車で1万2千円、普通車で9000円の反則金が科されるという。

一方、注意したいのが高速道路上での右側の車線、いわゆる追い越し車線を走り続けてしまう行為だ。本来であれば、左側の走行車線を走り、前の車を追い越しをしたい場合には右側の車線に出て追い越して、再び左側の走行車線に戻る、というのが交通ルールとなっているが、中には追い越し車線を走り続ける車も散見される。

こうした追い越し車線を走り続けた場合には「車両通行帯違反」となる恐れがあり、違反点数1点と大型車で7000円、普通車で6000円の罰金が科されることに。では、右側の追い越し車線を走り続ける車がのろのろ運転などで困った場合、左車線から追い抜く行為は違反になるのか?

新潟県警交通指導課によると「左車線からの追い抜きは法定速度内であれば問題ない」という。

■ エンジンかけたまま車を離れる行為は違反

ドライブ時には休憩などでパーキングやコンビニエンスストアを利用するドライバーも多いのではないだろうか。その際に気をつけたいのが、エンジンをかけたまま車を離れる行為だ。

道路交通法では「車両等を離れるときは、その原動機をとめ、完全にブレーキをかける等当該車が停止の状態を保つために必要な措置を講ずること」とあるほか「自動車又は原動機付き自転車を離れるときは、その車両の装置に応じ、その車両が他人に無断で運転されることがないようにするため必要な措置を講じること」と明記されていて、エンジンをかけっぱなしでコンビニなどで車を離れる行為は、実は道交法違反となっている。

車を使って旅行や帰省に出かけて楽しんだ人たちにとって、その思い出を台なしにしてしまうのが、事故だ。

事故に遭わないためには、交通ルールやマナーを守って車を運転することが求められる。車に乗り慣れているからといって過信しないこと、自宅に到着するまで気を抜かないことが大切だ。

"Until you get home, it's still an excursion." Many have heard this phrase from childhood, and it applies to those returning home from trips or visits during Golden Week. To ensure the end of enjoyable memories isn't marred by accidents or police interventions, here are some traffic rules to keep in mind before heading home.

■ Maintain Adequate Distance on Highways

Highways are essential for long-distance travel by car, but accidents can be deadly. It's crucial to adhere to traffic rules and speed limits. Of particular importance is maintaining "sufficient following distance" to avoid the dangerous phenomenon of tailgating, which has become a social issue in recent years.

Since June 2020, the Road Traffic Act has been amended to increase penalties for tailgating, emphasizing the need for adequate following distance. Failure to maintain this distance constitutes a violation, categorized as "failure to maintain safe following distance" and deemed as "obstructive driving (endangering traffic)," carrying penalties of up to three years imprisonment, fines up to 500,000 yen, or license revocation. While the law does not specify a precise distance for "sufficient following distance," it emphasizes maintaining a distance that allows for avoiding rear-end collisions.

According to the Niigata Prefectural Police Traffic Guidance Division, the distance required to come to a complete stop after braking, from the moment the driver perceives danger until the vehicle stops, is a combination of reaction distance and braking distance. Therefore, it's essential to maintain ample following distance on highways, especially at speeds of 80 km/h and 100 km/h, requiring stopping distances of 76m and 112m, respectively. When patrolling highways, if vehicles with insufficient following distance are observed, police may issue warnings via loudspeaker or even pull over and issue tickets or citations.

■ Running Out of Gas on Highways and Continuous Overtaking on the Right Lane

One concern on highways is running out of gas. Is it a violation if you run out of gas on the highway? According to the Road Traffic Act, running out of gas on highways is a violation categorized as "violation of obligations for drivers on expressways," resulting in two demerit points and fines of 12,000 yen for large vehicles and 9,000 yen for regular vehicles.

Another issue is continuously driving in the right lane, also known as the passing lane. Ideally, drivers should use the left lane for driving and switch to the right lane for overtaking before returning to the left lane. However, some vehicles continue to use the passing lane.

Continuously driving in the passing lane could constitute a violation of "driving in a lane reserved for other vehicles," resulting in one demerit point and fines of 7,000 yen for large vehicles and 6,000 yen for regular vehicles. However, according to the Niigata Prefectural Police Traffic Guidance Division, overtaking from the left lane is permissible as long as it's within the legal speed limit.

■ Leaving the Engine Running While Away from the Vehicle is a Violation

During a drive, many drivers take breaks at parking areas or convenience stores. However, it's essential to be mindful of leaving the engine running while away from the vehicle.

According to the Road Traffic Act, when leaving a vehicle unattended, the engine must be stopped, and appropriate measures must be taken to ensure the vehicle remains stationary. Leaving the engine running without taking such measures constitutes a violation of the law.

Never become overconfident just because you're familiar with driving, and remain vigilant until you arrive home safely.
